Acceptance of Terms
By accessing or using the services provided by Borderless Inc. ("Borderless," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms apply to all visitors, users, and clients who access our website or engage our services.
Description of Services
Borderless provides citizenship-by-descent consulting and application assistance services. We help clients assess their eligibility for citizenship in various countries, gather required documentation, and navigate the application process.
Our services may include:
- Eligibility assessments: Evaluating your potential eligibility for citizenship-by-descent programs based on the information and documentation you provide
- Personal Mobility Reports and Global Citizens Roadmaps: Detailed analyses of your citizenship-by-descent options across multiple countries
- Document gathering and preparation: Assisting with the collection, organization, translation, apostille, and preparation of required documentation
- Application filing and case management: Preparing and submitting citizenship applications to the relevant government authorities and managing your case through completion
- Ongoing consultation: Providing guidance, status updates, and support throughout the application process
Important: Our services are advisory and facilitative in nature. We are not a law firm and do not provide legal advice. We do not guarantee approval of any citizenship application, as final decisions rest solely with the relevant government authorities. Eligibility assessments are based on our interpretation of publicly available laws, regulations, and requirements, which are subject to change.
Service Engagement and Agreements
Specific service terms, scope of work, timelines, and fees are outlined in your individual service agreement or engagement letter. In the event of any conflict between these Terms and your service agreement, the service agreement shall govern with respect to the specific services covered.
User Obligations
By using our services, you agree to:
- Provide accurate, complete, and truthful information about yourself, your family history, and your eligibility
- Submit only authentic documents — providing forged, altered, or fraudulent documents is strictly prohibited and may constitute a criminal offense in multiple jurisdictions
- Respond promptly to requests for information, documentation, or action, as delays may affect your application timeline or eligibility
- Pay all fees in accordance with your service agreement and these Terms
- Not misrepresent your identity, ancestry, or eligibility for any citizenship program
- Not use our services for any unlawful purpose, including but not limited to evading sanctions, facilitating money laundering, or circumventing immigration laws
- Inform us promptly of any changes in your circumstances that may affect your eligibility or application, including changes in marital status, citizenship status, or legal name
You acknowledge that misrepresentation or fraud in a citizenship application may result in denial of the application, revocation of citizenship if granted, and potential criminal liability. Borderless bears no responsibility for consequences arising from inaccurate or fraudulent information provided by you.
Fees and Payment
Service fees are outlined in your service agreement. Unless otherwise specified in your agreement:
- Fees are non-refundable once work has commenced on your case, as our services involve significant upfront research, document procurement, and preparation that cannot be undone
- Payment plans, where offered, must be maintained according to the agreed schedule; failure to make timely payments may result in suspension of work on your case
- Third-party costs — government filing fees, document procurement fees, translation costs, apostille fees, notarization fees, and shipping costs are your responsibility and are separate from Borderless service fees
- Price changes — we reserve the right to modify our pricing with reasonable notice; any price changes will not affect services already under an active agreement
Refund Policy
Because our services involve substantial upfront work, refunds are handled as follows:
- Before work begins: If you cancel before we commence any work on your case, you are entitled to a full refund minus any applicable administrative fees
- After work begins: Refunds are prorated based on the work completed and costs incurred to date, as determined in good faith by Borderless
- Government and third-party fees that have already been paid on your behalf are non-refundable
- Eligibility assessments and reports that have been delivered are non-refundable, as they represent completed work product
Any refund requests should be submitted in writing to support@borderless.inc.
No Guarantee of Outcomes
You understand and agree that:
- Borderless does not and cannot guarantee that any citizenship application will be approved; approval decisions are made solely by the relevant government authorities
- Eligibility assessments represent our professional evaluation based on available information and our understanding of applicable laws, but do not constitute a guarantee of eligibility or approval
- Laws and requirements change — citizenship-by-descent requirements are subject to legislative changes, policy updates, and evolving administrative interpretations that may affect your eligibility or application at any time
- Processing times are estimates only and are subject to the schedules and backlogs of government agencies, which are outside our control
- We are not a law firm and our services do not constitute legal advice; for legal questions, we recommend consulting a licensed attorney in the relevant jurisdiction
Document Handling
Given the sensitive nature of the documents involved in citizenship applications:
- Original documents submitted to us will be handled with care, stored securely, and returned to you upon completion of your case or upon request
- We may retain copies of documents as necessary for case management and record-keeping purposes, subject to our Privacy Policy
- Risk of loss or damage — while we take every reasonable precaution, we cannot guarantee against loss or damage to documents during handling, shipping, or submission to government agencies; we recommend retaining your own copies of all original documents before submitting them to us
- Government submissions — once documents are submitted to a government agency, their handling and return are subject to that agency's policies and procedures, which are outside our control
Intellectual Property
All content, materials, tools, methodologies, reports, and intellectual property on our website and in our services are owned by Borderless or our licensors. This includes but is not limited to eligibility assessment frameworks, Personal Mobility Reports, Global Citizens Roadmaps, the Borderless Score, and any proprietary tools or processes.
You may not copy, reproduce, distribute, modify, or create derivative works from our materials without prior written consent.
Reports and deliverables prepared for you as part of your engagement are for your personal use only and may not be redistributed, resold, or published without our written permission.
Confidentiality
We treat your personal information and documents with strict confidentiality. We will only share your information as described in our Privacy Policy or as required to process your citizenship application.
You agree to treat any proprietary information, methodologies, or business processes shared with you during the course of our engagement as confidential.
Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing, we do not warrant that:
- Our services will result in successful citizenship applications
- Our eligibility assessments will reflect final government decisions
- Our website will be uninterrupted, secure, or error-free
- Any information on our website or provided through our services is complete, accurate, or current at all times
Limitation of Liability
To the maximum extent permitted by law, Borderless shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, or other intangible losses.
Our total liability for any claim arising out of or related to these Terms or our services shall not exceed the fees paid by you for the specific service giving rise to the claim.
This limitation applies regardless of the theory of liability, whether in contract, tort, strict liability, or otherwise, and even if Borderless has been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold harmless Borderless, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your breach of these Terms
- Your provision of inaccurate, incomplete, or fraudulent information or documents
- Your violation of any applicable law or regulation
- Any third-party claims related to your citizenship application that result from your actions or omissions
Termination
Either party may terminate the service relationship with written notice.
Upon termination:
- You remain responsible for any fees incurred for work already performed and costs already incurred on your behalf
- We will return your original documents upon request
- We may retain copies of documents and case records as described in our Privacy Policy
- Any provisions of these Terms that by their nature should survive termination will remain in effect, including confidentiality, limitation of liability, and indemnification
Dispute Resolution
In the event of a dispute arising out of or related to these Terms or our services, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in San Francisco, California.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. To the extent litigation is permitted, any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any applicable service agreement, constitute the entire agreement between you and Borderless regarding our services and supersede any prior agreements or communications.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website and updating the "Last updated" date. For active clients, we will provide additional notice of material changes via email.
Continued use of our services after changes constitutes acceptance of the modified Terms.
